The conduct of a lawsuit is called litigation. Litigation is a process through which a person who feels injured – the party plaintiff – files a complaint in court to hold one or more alleged wrongdoers – the parties defendant – to answer for the damages suffered. Defendants failing to respond to a properly served summons and complaint will lose the case by default. If the defendant responds timely, the parties usually engage in a process called discovery to learn more about the cases. With the help of their lawyers, the parties then use that information to better understand their rights, responsibilities and the likelihood of success at trial. This knowledge helps the parties to adopt a settlement posture which more often than not leads to reasonable settlement. If the pretrial dispute resolution process fails, the case will go to trial. The case will then be decided by a judge alone if the parties consent, or by a jury.
